The city of Boulder cannot force students to immediately leave their Ash House apartments, despite concerns about safety and illegal construction, a Boulder County judge ruled Tuesday.

Landmark Properties has completed The Standard at Eugene, a 703-bed, 247-unit student housing development located near the University of Oregon in Eugene, Ore., in time for the fall semester.

BOULDER, Colo. — Dozens of University of Colorado Boulder students are allowed to return to their apartments on University Hill after a judge on Tuesday ordered the city of Boulder to cease enforcement of a notice of closure that was issued Monday.

Just a month after moving into the Ash House, 60 University of Colorado students are now being forced out of their homes, and more than a dozen of them need to find new permanent housing.

A Boulder County District Court judge on Tuesday granted a temporary restraining order (TRO), barring the City of Boulder from further enforcing the closure of a student housing building on University Hill.

The notice was issued Monday afternoon. Last week, the city discovered the property owner created additional bedrooms without city approval.

Students living at Ash House in Boulder were told they could return temporarily. Dozens scrambled to move out Monday after the city found additional bedrooms were added without permit approval.

The city of Boulder gave notice Monday to the tenants of a privately owned, off-campus student housing building that the property owner had created bedrooms in each unit without city approval, and so the city was closing the property.

The City of Boulder has shut down an off-campus student housing building on University Hill due to "safety violations," giving 60 CU Boulder students only hours to collect their belongings and leave.
