A three-judge appeals court panel began hearing arguments as TikTok and ByteDance seek an injunction barring the law from taking effect.

A three-judge panel for the US Court of Appeals for the DC Circuit signaled skepticism of TikTok’s argument Monday that the law signed by President Biden banning the video-sharing app would violate the company’s free speech rights.

The 2-hour hearing Monday allowed TikTok and the government to give Appeals Court judges their opinions on a potential TikTok ban.

Pincus, the attorney for TikTok, said Congress should have erred on the side of disclosing any potential propaganda on the platform instead of pursuing a divesture-or-ban approach, which the two companies have maintained will only lead to a ban.
